Term and Conditions

1. Introduction

These Terms and Conditions govern the use of services provided by PT. Bayu Muda Karya Insani (“Company” or “We”). By utilizing our services, clients (“You”) acknowledge that You have read, understood, and agreed to these Terms and Conditions.

2. Services

The Company provides services in construction, distribution, and application of building materials, including:

• Procurement of Aluminium Composite Panels (ACP)
• Installation of aluminum frames, doors, and windows
• Application of other building materials.

Our services are tailored for construction projects involving office buildings, hospitals, shopping centers, and residential properties.

3. Rights and Obligations of the Company

1. Our Obligations:
   a. Provide high-quality products and services according to the agreed specifications.
   b. Complete work within the timeframe stated in the contract, except in cases of force majeure.
   c. Provide regular progress reports to clients.
2. Our Rights:
   a. Collect payments in accordance with the terms of the contract.
   b. Suspend or terminate work if the client fails to fulfill their obligations, including payment.

4. Rights and Obligations of the Client

1. Your Obligations:
   a. Provide complete and accurate project information and supporting documents.
   b. Make payments as per the agreed schedule.
   c. Ensure the project site is ready for work to commence.
2. Your Rights:
   a. Receive services as specified in the agreement.
   b. Obtain regular updates on project progress.
   c. File complaints in the event of discrepancies in services or products.

5. Work Agreement

All services provided by the Company are based on a written agreement signed by both parties. The agreement includes the scope of work, technical specifications, schedule, and cost.

6. Payments

1. Payments must be made according to the schedule stated in the contract.
2. Late payments may incur penalties or result in work delays.
3. All costs arising from payment delays are the responsibility of the client.

7. Warranty and Claims

1. We provide a quality warranty for products and services for a specified period as stated in the contract.
2. Claims for damages or service discrepancies must be submitted within 14 days of project completion.

8. Force Majeure

We are not liable for delays or failure to perform services due to circumstances beyond our control, including natural disasters, fires, floods, operational disruptions, or government regulations.

9. Data Protection

We maintain the confidentiality of all data and information provided by You. Your data will only be used for project execution purposes and will not be shared without your consent, except as required by law.

10. Dispute Resolution

1. Any disputes arising from these Terms and Conditions will be resolved amicably through mutual discussion.
2. If mutual discussion fails, disputes will be resolved through legal proceedings at the District Court of Depok.

11. Amendments to Terms and Conditions

We reserve the right to amend or update these Terms and Conditions at any time. Any changes will be communicated to clients via email or our official platform.

12. Governing Law

These Terms and Conditions are governed by and interpreted under the laws of the Republic of Indonesia.
